Cara Taxi – Pakistan

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Cara Taxi platform ("Platform"), including its mobile applications, website, and related services.

Cara Taxi operates solely as a technology platform that connects Riders with independent Drivers. Cara Taxi does not provide transportation services and does not own, operate, or control any vehicles.

By accessing or using the Platform, you agree to be legally bound by these Terms and Conditions.

2. Definitions

• Rider – A user who books transportation through the Platform.
• Driver – An independent driver or transportation service provider using the Platform.
• Platform – Cara Taxi's mobile applications, website, and related services.
• Ride – Transportation service provided by a Driver to a Rider.

3. Platform Role

• Cara Taxi acts only as an intermediary technology platform.
• The transportation contract is solely between the Rider and the Driver.
• Cara Taxi is not a transportation provider and is not responsible for the execution or quality of rides.

4. Eligibility

• You must be at least 18 years of age to use the Platform.
• You must provide accurate, current, and complete information during registration and while using the Platform.
• You are responsible for maintaining the security of your account credentials.

5. Rider Terms

5.1 Booking & Payments

• Riders may request rides through the Platform.
• Fares may be calculated using:
  • Platform fare calculations
  • Meter-based pricing where required under applicable Pakistani transport regulations
  • Estimated fares displayed within the application
• Available payment methods may include:
  • Credit Cards
  • Debit Cards
  • Digital Wallets
  • Cash (where available)

5.2 Rider Responsibilities

• Provide accurate pickup and destination locations.
• Be present at the pickup location on time.
• Treat Drivers and vehicles respectfully.
• Comply with all applicable laws while using the Platform.

5.3 Rider Cancellation Policy

A cancellation fee may apply if:

• The Rider cancels more than five (5) minutes after the Driver accepts the ride.
• The Driver has arrived at the pickup location and waited at least five (5) minutes before cancellation.

Cara Taxi reserves the right to:

• Automatically charge the Rider's payment method for cancellation fees.
• Recover unpaid cancellation fees.
• Restrict or suspend Rider accounts until outstanding balances are cleared.

6. Driver Terms

6.1 Independent Contractor Status

Drivers are independent contractors. Nothing contained in these Terms shall create any employment, agency, partnership, or joint venture relationship between Cara Taxi and any Driver.

6.2 Driver Obligations

• Hold a valid driving licence and any commercial transport permits required under the laws of Pakistan.
• Maintain valid vehicle registration and insurance where required by applicable law.
• Ensure the vehicle is safe, roadworthy, and properly maintained.
• Provide professional, lawful, and courteous transportation services.
• Comply with all applicable traffic laws and transport regulations.

6.3 Driver Payments

• Drivers receive fares paid by Riders.
• Cara Taxi deducts its agreed platform commission.
• Payouts may be processed periodically according to the Platform's payout schedule.

6.4 Driver Cancellation Policy

• If a Driver arrives at the pickup location and waits at least five (5) minutes before cancelling due to Rider absence, the Driver may be eligible for a cancellation fee.
• The cancellation fee will be credited to the Driver's wallet after deduction of the applicable platform commission.

7. Community Guidelines

All users must:

• Treat others with courtesy and respect.
• Not engage in harassment, abuse, discrimination, or threatening behaviour.
• Not participate in unlawful activities.
• Respect the privacy and safety of other users.

Violation of these guidelines may result in temporary suspension or permanent termination of the account.

8. Payments & Fees

• Payments shall be processed using approved payment methods available on the Platform.
• Additional charges may include waiting time, tolls, parking fees, or other applicable charges.
• Cara Taxi reserves the right to modify pricing, commissions, service fees, and payment policies at any time.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Cara Taxi does not guarantee:

• Availability of Drivers.
• Availability of Riders.
• Quality, safety, or legality of transportation services.
• Timely arrival or completion of rides.

Cara Taxi is not responsible for:

• The conduct of Drivers or Riders.
• Accidents occurring during transportation.
• Lost or damaged personal belongings.
• Any disputes arising directly between Riders and Drivers.

10. Limitation of Liability

To the maximum extent permitted under the laws of Pakistan, Cara Taxi shall not be liable for any:

• Indirect, incidental, special, or consequential damages.
• Loss of profits, income, business, data, goodwill, or property.
• Claims arising from services provided by independent Drivers.

11. Suspension & Termination

Cara Taxi reserves the right to suspend or permanently terminate any account that violates these Terms, applicable laws, or the Platform's policies, with or without prior notice.

12. Privacy & Data Protection

Your use of the Platform is also governed by the Cara Taxi Privacy Policy. By using the Platform, you consent to the collection, use, and processing of your information as described in the Privacy Policy.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Pakistan.

14. Amendments

Cara Taxi may modify or update these Terms and Conditions at any time. Continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms.
